Parties sometimes refrain from proposing the other party to settle their differences either through Negotiation or Mediation because they think that may reveal a weakness in their positions.[1]
This is a common belief between disputants. They believe that the only reason why someone will propose a settlement is because that someone feels that he or she is in a weak position and therefore prefers to settle than to loose everything in a lawsuit or arbitration.
In order to avoid the other party from having these thoughts, parties prefer to fight and do not realize that it is then when they are really loosing everything. They are wasting time and money to make the other party believe that they are strong.
In Mediation, parties can solve their disputes directly. They have control over the process and the outcome, because it is them who decide how to resolve their dispute; no one is imposing a solution.
